1. General Provisions
1.1. The Seller is LinenBuy, a legal entity whose goods are sold on the website https://linenbuy.com (hereinafter referred to as the “Seller”). The Seller is responsible for the proper fulfillment of orders placed by the Buyer in accordance with these Terms and Conditions.
1.2. The Buyer may be:
- an individual with full legal capacity (a person who has reached the age of majority and whose legal capacity has not been restricted by a court);
- a minor between the ages of fourteen (14) and eighteen (18), with the consent of a parent or legal guardian, unless legally emancipated;
- a legal entity.
1.3. These Terms and Conditions of Sale and Purchase (hereinafter referred to as the “Terms”) constitute a legally binding agreement between the Buyer and the Seller and define the rights and obligations of both parties, as well as the conditions of purchase, payment, delivery, return, and other provisions related to the sale of goods through the e-shop https://linenbuy.com (hereinafter referred to as the “E-Shop”).
1.4. Before placing an order, the Buyer confirms that they have read, understood, and agreed to these Terms.
1.5. The Seller reserves the right to amend, modify, or supplement these Terms at any time in accordance with the laws of the Republic of Lithuania.
1.6. It is the Buyer’s responsibility to review these Terms periodically. Continued use of the E-Shop after changes are published constitutes acceptance of the revised Terms.
2. Conclusion of the Contract
2.1. The contractual relationship between the Buyer and the Seller is deemed concluded when:
2.1.1. The Buyer places an order in the E-Shop; and
2.1.2. The Buyer provides all required information, specifies the delivery address, and confirms the order by clicking the “Buy” or equivalent confirmation button.
3. Buyer’s Rights and Obligations
3.1. By placing an order in the E-Shop https://linenbuy.com, the Buyer agrees to comply with these Terms and applicable laws of the Republic of Lithuania.
3.2. The Buyer undertakes to accept the ordered goods and pay the agreed price.
3.3. The Buyer must provide complete, accurate, and truthful information when placing an order. If inaccurate or misleading data is provided, the Seller has the right to cancel the order and delete related data.
3.4. If the Buyer’s personal data changes, the Buyer must update it promptly and inform the Seller by email at info@linenbuy.com.
3.5. The Buyer may cancel an order only if it has not yet been dispatched. Dispatched orders may be returned in accordance with the Return Policy.
3.6. The Buyer has the right to withdraw from the contract only if the goods are unused, undamaged, and have not lost their original appearance. Detailed conditions are provided in the Return Policy.
4. Seller’s Rights and Obligations
4.1. The Seller undertakes to comply with these Terms and provide access to the E-Shop services.
4.2. The Seller respects the Buyer’s right to privacy and handles personal data in accordance with the Privacy Policy.
4.3. The Seller undertakes to deliver the goods to the address provided by the Buyer.
4.4. If the ordered goods cannot be delivered due to significant circumstances, the Seller may offer a similar or equivalent product. If the Buyer refuses, a refund will be issued within fourteen (14) business days, provided payment has been made.
4.5. The Seller may establish a minimum order value required to qualify for free delivery. This information is provided in the Shipping Policy.
4.6. The Seller has the right to restrict or suspend access to the E-Shop if the Buyer attempts to disrupt its operation or breaches these Terms.
4.7. If order details are unclear, the Seller may contact the Buyer. If the Buyer does not respond within three (3) business days, the Seller has the right to cancel the order.
4.8. The Seller may cancel an order in cases of stock shortages, technical errors, or website malfunctions that prevent order fulfillment. The Buyer will be informed and refunded accordingly.
5. Product Ordering, Prices, and Payment
5.1. Orders can be placed in the E-Shop 24 hours a day, 7 days a week.
5.2. Product prices are listed in euros (or other displayed currencies) and include VAT.
5.3. The Seller does not cover customs duties, taxes, or fees imposed by the Buyer’s country.
5.4. Payment methods include:
- electronic banking;
- credit or debit card.
5.5. Prices confirmed at the time of order shall not change unless due to technical errors. In such cases, the Buyer may cancel the order and receive a refund.
6. Delivery and Collection
6.1. The Buyer may choose delivery via courier service or collection from the Seller’s physical store (if available).
6.2. The Buyer must provide an accurate delivery address.
6.3. The Buyer undertakes to accept the goods personally or ensure acceptance at the provided address.
6.4. Delivery is carried out by the Seller or an authorized representative.
6.5. The Seller is not liable for delivery delays caused by circumstances beyond their control.
6.6. Upon receipt, the Buyer must inspect the goods and immediately notify the Seller of any damage or defects.
7. Product Quality and Warranty
7.1. Product characteristics are described on individual product pages.
7.2. Product appearance may vary slightly due to screen settings. Linen discoloration and shrinkage are natural properties and are not considered defects.
7.3. Consumer rights under applicable law remain unaffected.
7.4. The Seller does not provide after-sales servicing.
8. Returns and Exchanges
8.1. Returns are processed in accordance with Lithuanian law and the Seller’s Return Policy.
8.2. Return requests must be submitted via email to info@linenbuy.com.
8.3. Returned goods must be unused, undamaged, and in original condition unless defective.
9. Liability
9.1. The Buyer is responsible for the accuracy of provided personal data.
9.2. The Seller is not liable for losses resulting from incorrect Buyer information.
9.3. Each party is liable for damages caused by their own actions.
10. Final Provisions
10.1. These Terms are governed by the laws of the Republic of Lithuania.
10.2. Any disputes shall be resolved through negotiation. If no agreement is reached within twenty (20) calendar days, disputes shall be settled in accordance with Lithuanian law.
